Eagle Butte Men Arraigned on Burglary Charge

U.S. Attorney Brendan V. Johnson announced that two Eagle Butte men have been indicted by a federal grand jury for Third Degree Burglary.

Delon Holy Bear, age 42, and Clinton Buckman, age 31, were indicted by a federal grand jury on October 12, 2011. They both appeared before U.S. Magistrate Judge Mark A. Moreno on October 19, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is 10 years' imprisonment. The charge is merely an accusation, and both Holy Bear and Buckman are presumed innocent until and unless proven guilty.

The investigation is being conducted by the Cheyenne River Sioux Tribe Law Enforcement Division. Assistant U.S. Attorney Britt Haxton is prosecuting the case. Both defendants were remanded to the custody of the U.S. Marshal. A trial date has not yet been set.
